1. Agreement to Terms

By accessing our website, submitting your information, scheduling an appointment, or engaging with any representative of SunPerks ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

2. Nature of Our Services

SunPerks is a sales and marketing organization that promotes green and solar energy products and services on behalf of licensed third-party installation and financing companies. Our services are limited to:

• Educating prospective customers about solar energy benefits and available programs.
• Generating leads and scheduling consultations with qualified energy providers.
• Facilitating introductions between consumers and licensed solar installation partners.

SunPerks does not design, manufacture, sell, install, service, repair, or warranty any solar energy equipment or systems. We are not a licensed solar contractor or electrician.

3. No Liability for Installation or Products

All installation work, equipment, products, warranties, financing agreements, and post-sale support are the sole responsibility of the licensed installation and financing partners to whom you are referred. SunPerks expressly disclaims all liability for:

• The quality, performance, or fitness of any solar equipment or system.
• Any installation defects, damages, or injuries arising from installation activities.
• Product malfunctions, warranty claims, or service failures.
• Financial terms, loan agreements, lease terms, or power purchase agreements offered by financing partners.
• Any representations made by installation or financing partners beyond what our representatives have stated.

Your agreement for installation services will be with the licensed installer, not with SunPerks. Please review all contracts carefully before signing.

4. SMS Communications & Consent

By providing your mobile phone number and/or scheduling an appointment, you expressly consent to receive transactional and informational SMS text messages from SunPerks, including but not limited to appointment confirmations, scheduling reminders, and follow-up communications.

• Consent to receive SMS messages is not a condition of purchase or consultation.
• You may opt out at any time by replying STOP to any message.
• Message and data rates may apply. Message frequency varies.
• For help, reply HELP to any message.

5. Appointment Scheduling

Scheduling an appointment through our platform does not constitute a contract for services or any guarantee of pricing, availability, or installation timelines. Appointments are for consultations only. Any binding agreements will be made directly between you and the licensed installation or financing partner.

We reserve the right to reschedule or cancel appointments due to partner availability, weather, or other circumstances. We will make reasonable efforts to notify you in advance.

6. No Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUNPERKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

8. Indemnification

You agree to indemnify, defend, and hold harmless SunPerks and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any rights of another party.

9. Third-Party Partners

We may refer you to third-party solar installation or financing companies. These companies are independent and not agents or employees of SunPerks. We do not control, endorse, or assume responsibility for the products, services, or content of any third-party partner. Your dealings with these partners are solely between you and them.

10. Intellectual Property

All content on our website and platforms, including text, graphics, logos, and software, is the property of SunPerks or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

12. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Updated terms will be posted on this page with a revised effective date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
